Warner YouTube copyright claim on Muse concert clips

Something that occurred a couple of years back now when I posted some dodgy low quality concert videos I took at Muse’s homecoming gigs at Teignmouth.

Warner at the time waded in straight away and claimed copyright on them, and YouTube took them down. Annoyed I was but given the warnings on YouTube’s help page about counter claims and possible legal actions if you proceed, I decided not to take it further.

Problem is I still have a black mark on my YouTube account now, and I’m still unsure their claim is valid.

Keep thinking I should still challenge this on the basis that:

– Their claim is likely via the DMCA which is US law. I live in the UK, footage was shot in the UK
– Quality is low
– It’s non profit
– Serves no threat to the artist or Warner
– Promotes the concert and band

Could also argue that the band are happy with (and I think even promote to some degree) bootlegs of concerts. There are some exceedingly high quality bootlegs about, even of this concert. My humble low quality videos are hardly an issue at all.

Problem with the UK is we have no fair use in copyright law unlike the US, so despite the DMCA I’d probably have more success there.

But don’t know really. I’d just like them to remove the black mark mainly.

MUSE fully signed 2010 Glastonbury ticket with poster Worthy charity plug on behalf of the Kirks who are auctioning their guest Glastonbury ticket, signed by all members of MUSE and Morgan Nicholls (session musician), to raise funds for The Helen Foundation who help Teignbridge youngsters to pursue their dreams & talents in the arts.

Also includes poster of 52 different album covers and original setlist.

The ticket is believed to be unique in being signed by all members, and is fully authenticated by Mr Kirk, chairman of The Helen Foundation (and father of Tom “MUSE Media Manager” Kirk who has donated the setlist also).

Get bidding, or if you can’t afford it, spread the word via Twitter, Facebook and whatnot!…

Nokia E72 update

Nokia E72 After a long wait, I’ve got a firmware update on the E72. This is 031.023. I’ve been using it for a while now and have to say that things have settled down a bit.

The Good:

1. Less crashes

2. Feels more responsive (but this is because the transitions have been turned off by default)

3. The spacebar bug seems to have gone away

4. Haven’t had to reformat the phone

5. d-pad selector responds better when pressing down, light or hard, on it.

The Bad:

1. Email client still doesn’t support Destinations.

2. They bundled Smart Connect to address point 1 (sloppy way of addressing it. Just implement Destination!)… but the version they bundled doesn’t work! Although there is a patch available

3. GPS is broken. It can take forever to lock on, and sometimes not at all. Works worst in Maps, and works better when another app locks on the GPS first. Maps annoyingly doesn’t make it clear what kind of ‘lock’ it has (GPS, cell, WiFi), which became an issue when I had reason to direct emergency services only to realise it was locked to the cell position despite being in the countryside with clear blue sky.

4. Email client still feels clunky, the email viewer is rubbish, and the client can lock up the phone sometimes when flicking through menus and options, and especially when it’s been on a 3G connection for a while.

Edit: I had some videos on YouTube, but Warner have taken them down due to “copyright infringement” (in a public place like The Den and with no notice of copyright on the tickets? Hmm).

Thanks Warner! Under US copyright law I’d probably have a fair chance of challenge under fair use, especially given it’s a public place, low quality, not for profit, and of no threat (if anything a positive promotion for them).
